Child Support and Support Modifications

Child support is determined based on California State child support guidelines, taking into account the amount of time each parent spends with the child and the gross income of the two parties. But child support may need to be modified over time due to changing circumstances. For example, if a parent loses a job, child support can be adjusted downward. If a parenting plan calls for a parent to have visitation several days a week and the parent does not take custody of the child at all, financial support would likely be adjusted upward.

Child Visitation Modifications

Move-away laws have become more liberal. A co-parent may get a new job in another state or get married and wish to move with his or her new spouse. Because that parent will be depriving the other parent of visitation—or at the very least making visitation much more difficult—the proper way to handle this change of circumstance is to go back to court for a post-judgment modification.
